You actually have two questions here. The name of your business, for legal purposes, must be unique within your state. Your Secretary of State's office has a way for you to search businesses registered in your state. Most states have a way for you to reserve your name prior to registering your legal entity (LLC or Corporation).

A trademark protects your brand name (and/or logo) and can be registered at the state or national level. A national trademark is recommended, and the US Patent and Trademark office has a search of their database of registered trademarks.

You can do web searches to see if there are other businesses with the name you want to use. With the advent of the internet, it is recommended to find a unique name, even if you are not in the same state.

Trade mark it!

You have to go online and check and see if someone owns the Name first... if not you pay for them to trade mark it...it cost a few g's

If you go to your secretary of states website you should be able to search and see if the name has been taken already and you should also be able to register for that name.
