The name of your business, for legal purposes, must be unique within your state. Your Secretary of State's office has a way for you to search businesses registered in your state. A national trademark is recommended, and the US Patent and Trademark office has a search of their database of registered trademarks. You can do web searches to see if there are other businesses with the name you want to use.
